1. Service Agreement

Welcome to Precision Auto! These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

Our services include, but are not limited to, oil changes, brake services, engine diagnostics and repair, tire services, battery services, and collision repair. These services are subject to availability and our professional assessment.

When you schedule an appointment with us, you enter into a service agreement. This agreement outlines the services we will provide, the estimated cost, and the expected timeline. We strive to provide accurate estimates, but unforeseen issues may arise that require additional work and cost. In such cases, we will contact you for approval before proceeding.

We reserve the right to refuse service to anyone for any reason. We may also modify or discontinue our services at any time without notice.

2. User Responsibilities

As a user of our services, you are responsible for providing accurate and complete information about your vehicle and its issues. Failure to provide accurate information may result in incorrect diagnoses and ineffective repairs.

You are responsible for ensuring that your vehicle is legally compliant and safe to operate. We are not responsible for any damages or liabilities arising from your vehicle's non-compliance with applicable laws and regulations.

You agree to pay all charges for services rendered, including parts and labor. Payment is due upon completion of the service unless otherwise agreed upon in writing. We accept cash, credit cards, and debit cards. We may also offer financing options subject to credit approval.

You are responsible for picking up your vehicle promptly after we notify you that the service is complete. We may charge storage fees for vehicles left on our premises for an extended period.

You agree to treat our staff with respect and refrain from abusive or offensive behavior. We reserve the right to refuse service to anyone who violates this provision.

3. Limitations of Liability

To the fullest extent permitted by law, Precision Auto shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website or services. This includes, but is not limited to, damages for lost profits, lost data, or business interruption.

Our liability for any direct damages shall be limited to the amount you paid for the services giving rise to the claim. We are not responsible for pre-existing conditions or damages that are unrelated to the services we provided.

We are not liable for delays or failures in performing our services due to events beyond our reasonable control, such as natural disasters, strikes, or government regulations.

We provide a warranty on our workmanship for a period of 12 months or 12,000 miles, whichever comes first. This warranty covers defects in our workmanship but does not cover parts or components that fail due to normal wear and tear or misuse.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

4. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of our website or services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

Before initiating arbitration, you agree to first attempt to resolve the dispute amicably through good faith negotiations with Precision Auto. You may contact us at [email protected] or (415) 555-0123 to initiate negotiations.

The arbitrator's decision shall be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.

Each party shall bear its own costs of arbitration, including attorney's fees, except that the arbitrator may award reasonable attorney's fees to the prevailing party if the arbitrator determines that the other party's claim or defense was frivolous or brought in bad faith.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Francisco, California, and you consent to the jurisdiction of such courts.
